1. Using Nexify

Nexify is a market research and audience validation platform designed for founders and product builders. The service enables you to analyze product concepts, discover and synthesize relevant public community discussions, and publish public validation landing pages to measure customer interest.

By creating an account, accessing the dashboard, or utilizing our public validation features, you agree to comply with and be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the service.

Eligibility: You must be at least 18 years old, or the legal age of majority in your jurisdiction, to create an account and enter into this agreement. If you use Nexify on behalf of an organization, you represent that you have authority to bind that entity to these Terms.

2. Accounts

To use Nexify’s research and validation tools, you must register for an account by providing an email address and creating a secure password.

• Accuracy: You agree to provide a valid email address that you control. This address is used to communicate essential account notifications, security alerts, and service updates.
• Security: You are responsible for safeguarding your login credentials and any API tokens issued to your account. You agree not to disclose your credentials to third parties and to accept responsibility for all activities conducted under your account.
• Individual access: Accounts are granted for individual use. Sharing a single login across multiple unauthorized parties is not supported.
• Unauthorized use: You agree to notify us immediately at hello@thenexify.app if you detect or suspect any unauthorized access to your account.

3. Your content

You retain full ownership and intellectual property rights in all ideas, project descriptions, questionnaire copy, branding choices, images, and other materials you input or create in Nexify (“User Content”). Nexify does not claim any ownership over your concepts or content.

Limited license to operate: By submitting User Content to Nexify, you grant us a non-exclusive, worldwide, royalty-free license solely to host, process, display, format, and transmit that content as necessary to operate the service on your behalf (such as transmitting prompts to our configured AI and research providers to generate your reports).

Privacy of your ideas: Your private project hypotheses and research runs are kept confidential to your account. We do not publish your ideas, share them with other users, or use your proprietary project data to train public artificial intelligence models.

4. Validation pages

Nexify allows you to generate and publish public validation landing pages to gauge market interest from potential customers. When you publish a validation page, the following rules apply:

• Your responsibility: You are solely responsible for all text, headlines, pricing options, representations, and claims published on your validation page.
• Truth in marketing: You must not deceive or mislead visitors regarding the current development state of your offering. If an idea is pre-launch, unbuilt, or undergoing market discovery, your page must accurately reflect its status.
• Handling responder data: When visitors submit their email address or written feedback through your page, you act as the data controller for that information. You agree to use responder contact information solely for the stated validation purpose, to respect requests for deletion, and never to sell responder lists or send unsolicited bulk spam.
• Platform status: Nexify provides the software infrastructure to host and serve validation pages. Nexify does not endorse, verify, or guarantee any claim made on a user-published page.

5. Research and third-party content

To assist in your market research, Nexify surfaces and analyzes publicly accessible online discussions, currently drawn from public Reddit threads via research APIs or public endpoints.

• Third-party ownership: All third-party discussion titles, post excerpts, comments, and links belong to their original authors and platforms. Storing public excerpts for your research does not constitute an endorsement or claim of ownership by Nexify.
• Decision-support information: Research outputs, AI-generated hypotheses, and community recommendations are analytical tools provided for decision support. They reflect public discussions at a given moment and should not be relied upon as legal, financial, or investment advice. You are encouraged to review the original linked discussion threads before making business commitments.
• Removal requests: If the author of a public post wishes to have an excerpt removed from project records, a removal request may be sent to hello@thenexify.app with the relevant thread link.

6. Subscriptions and payments

Nexify provides tiered subscription plans with differing project quotas, research run capacities, and validation capabilities:

• Explore: $0 / month — Free plan for initial concept exploration and standard research.
• Validate: $19 / month — Expanded research runs, deep audience signals, and full validation features.
• Find: $39 / month — High-volume discovery, 15 active projects, elevated research quotas, and premium capabilities.

Merchant of Record: All subscription checkouts, payment processing, invoicing, and sales tax/VAT compliance are handled by our Merchant of Record, Creem (creem.io). Creem is the merchant of record for all our customer transactions, processes your card data securely under PCI-DSS standards, and manages international tax collection. Nexify does not store full payment card details.

Renewals and Cancellation: Paid subscriptions are billed on a recurring monthly basis unless canceled. You can cancel your subscription at any time with 1-click directly from your account settings. Upon cancellation, your subscription remains active and you retain access to your plan entitlements until the end of your current paid billing period, with no further charges.

Refund Policy: If you experience technical issues that prevent you from using your plan, or if you are unsatisfied with your subscription, please contact support at hello@thenexify.app within 14 days of billing. Eligible refund requests are reviewed promptly and processed back to your original payment method via Creem.

7. Acceptable use

You agree to use Nexify lawfully, responsibly, and ethically. You agree not to use the platform to:

• Violate any applicable local, national, or international law or regulation.
• Interfere with, disrupt, or compromise the integrity, performance, or security of the service or its underlying infrastructure.
• Probe, scan, or attempt to gain unauthorized access to accounts, projects, validation pages, or systems belonging to other users.
• Scrape, harvest, or republish platform data or resell Nexify’s research outputs as a competing standalone dataset without written permission.
• Circumvent rate limits, feature restrictions, or plan quotas.
• Publish or distribute content that is defamatory, fraudulent, harassing, obscene, or that infringes on third-party intellectual property or privacy rights.
• Send unsolicited communications (spam) or violate the community guidelines of any external platform or forum you engage with.

8. Intellectual property

Nexify rights: The Nexify platform, including its software code, user interface, design assets, logos, brand identity, documentation, and algorithms, is the exclusive property of Nexify and its licensors, protected by copyright, trademark, and intellectual property laws.

User rights: As described in Section 3, all intellectual property rights in your submitted ideas, project notes, and custom validation page copy remain exclusively yours.

Feedback: If you choose to provide suggestions, feature requests, or feedback regarding Nexify, we may freely use and incorporate that feedback to improve the service without obligation or compensation to you.

9. Service availability

We aim to provide a reliable, stable platform. However, access to Nexify may occasionally be interrupted, limited, or delayed due to scheduled maintenance, software updates, hosting environment constraints, or third-party service provider outages.

Research runs are processed in resumable stages to handle transient network delays or rate limits gracefully. The service is provided without a formal service level agreement (SLA) or guarantee of uninterrupted uptime.

10. Disclaimers

Important note: Nexify is an analytical tool built to gather market signals and community feedback. It does not guarantee that any idea will succeed, that commercial demand exists, or that visitors will purchase your future product.

To the fullest extent permitted by applicable law, the service is provided on an “as is” and “as available” basis. Nexify expressly disclaims all warranties of any kind, whether express, implied, or statutory — including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that research findings will be exhaustive or error-free, that AI summaries will always be accurate, or that validation pages will receive any specific number of responses. Visitor responses reflect opinions expressed at a single moment in time and do not constitute contracts, commercial commitments, or investment forecasts.

11. Limitation of liability

To the maximum extent permitted by applicable law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising from or related to your use of Nexify.

To the maximum extent permitted by applicable law, Nexify’s total aggregate liability arising out of or related to these Terms or the service shall not exceed the total amount actually paid by you to Nexify for the service during the twelve (12) months immediately preceding the event giving rise to liability, or fifty US dollars ($50.00), whichever is greater.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under applicable consumer protection legislation.

12. Your responsibility for claims

You agree to defend, indemnify, and hold harmless Nexify, its operators, officers, and contractors against any third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of or access to the service; (b) any content, claims, or validation pages you publish; (c) your violation of these Terms; or (d) your collection, handling, or use of personal data gathered from validation page responders.

13. Termination

You may stop using Nexify and close your account at any time by contacting us.

We may suspend or terminate your access to the service if we reasonably determine that you have breached these Terms, engaged in fraudulent or abusive activities, or posed a legal or technical risk to the platform, other users, or third-party providers.

Upon account closure or project deletion, associated research runs, cached findings, and validation pages are permanently deleted. The provisions of Sections 3, 7, 8, 10, 11, 12, 15, and 16 will survive any termination of these Terms.

14. Changes to these Terms

We may update these Terms of Service from time to time to reflect product enhancements, operational adjustments, or changes in legal requirements. When revisions occur, the updated Terms will be posted on this page with an updated “Last updated” date.

For material changes that significantly affect your rights, we will provide additional notice through your account email or a platform announcement where feasible. Continued use of Nexify following the effective date of updated Terms constitutes your acceptance of the changes.

15. Governing law and disputes

These Terms and any dispute arising from or relating to them shall be governed by and construed in accordance with the laws of the jurisdiction in which the service operator is established, without giving effect to conflict of laws principles.

Before initiating formal legal proceedings, the parties agree to make a good-faith attempt to resolve any dispute informally by contacting hello@thenexify.app.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
